PROCON LOSES IN COURT

The request for an injunction is denied and Flamengo has no restrictions on the pricing of games.

Judge Luiz Roberto Ayoub of Rio de Janeiro's first business court denied the preliminary injunction in the public civil action filed by Procon against Flamengo seeking to limit ticket price increases to up to 30%. See the full ruling.

"This is an action whose objective is the alleged abusiveness of the price charged for tickets for the 1st defendant's match, to be held on an upcoming date. The plaintiff claims that the maximum increase in ticket prices should not exceed 30%, relying, for this purpose, on the principle of reasonableness. He further alleges a lack of proof of the costs to justify the aforementioned charge. He therefore requests the granting of a judicial ruling in urgent relief, since the match was scheduled for November 27, 11, and tickets were already on sale. This is the brief report. I decide. I deny, for the time being, the requested anticipation of the effects of the relief. The pricing, in this specific case, depends on a more in-depth analysis, and it is questionable to what extent the Judiciary should interfere in the quantification of what is or is not reasonable with regard to the ticket price, considering the private nature of the activity. Furthermore, the plaintiff's assertion that the increase could not exceed 2013% compared to what has been practiced until now is also the subject of greater questioning. Therefore, any statement at this time is inappropriate, considering the lack of a prima facie case.
