Clube de Regatas do Flamengo publicly regrets the Brazilian Football Confederation's (CBF) decision to comply with the recommendation of the São Paulo State Public Prosecutor's Office (MP-SP). The agency instructed the São Paulo Football Federation (FPF) to hold the match between Flamengo and Palmeiras at Allianz Parque, for the 36th round of the Brazilian Championship, with a single fan base, prohibiting ticket sales to the red-and-black fans.
Acceptance of this decision represents a violation of the competition's rules and principles, as well as a benefit to the offender—who will play in the presence of the only fans of the Alviverde team, thus gaining a sporting advantage—and the creation of catastrophic precedents for the organization of Brazilian football. The prohibition of coexistence between red-black and white fans and green-and-white fans decrees the collapse of public safety and the death of Brazilian football's grandstand culture.
Clube de Regatas do Flamengo brings up the following arguments:
- Article 86 of the 2019 General Competition Regulations grants the visiting club the right to purchase a maximum of 10% of the stadium's permitted capacity. Failure to do so would be a serious violation of the rights of fans and clubs, going against the very nature of the spectacle and the competition;
- The principle of reciprocity was not respected: in the first round, Flamengo guaranteed Sociedade Esportiva Palmeiras a 10% share of the tickets for the game at the Maracanã stadium, with the Military Police fully guaranteeing the safety and physical integrity of all people involved in the event;
The São Paulo Public Prosecutor's Office or any other Public Prosecutor's Office has no standing to make recommendations to private entities. They should have sought such a resolution from the Judiciary.
Considering the aforementioned facts, the Club will forward the MP's request to the Superior Court of Justice (STJD) Prosecutor's Office, so that the agency can take appropriate action. If the Military Police do not feel able to provide security for all those involved in the match, it should be held at another location or behind closed doors.
Clube de Regatas do Flamengo reiterates its total repudiation of violence and rejects any type of demonstration contrary to football culture.
