DThroughout this week, the most debated topic in the sports world was the impact that the new football provisional measure could have on broadcasting rights for Brazilian football matches. Rodrigo Dunshee, Flamengo's Vice President of General and Legal Affairs, clarified some important points on the topic. See below:

984 Provisional Measure

"MP 984, which has the force of law, allows the home club to broadcast its games without the need for anyone's authorization. This is the regular exercise of a right recognized by law."

Broadcasting rights

Flamengo has no contract with TV Globo regarding the Campeonato Carioca. There is no vested right under the legal regime; what Globo holds are the broadcast rights of the other clubs, which, according to the Provisional Measure, are limited to home matches. The contract makes it clear that the broadcaster has no rights with Flamengo.

Flamengo's positioning

"Flamengo didn't sign a contract, so it can't suffer any kind of loss. The TV Globo contract is with the other clubs participating in the Campeonato Carioca. Flamengo understands that it can assign its rights because it doesn't have a current contract with the broadcaster."

Negotiation with TV Globo

"The negotiations aren't over; no one is taking it personally. Globo is our partner in the Brazilian Championship and other tournaments. It's a potential client for the Carioca Championship. Currently, there's no contract with TV Globo, so Flamengo is free to exercise a legally recognized right. We're open to receiving proposals from Globo, as well as from other channels and digital platforms."
